The Supreme Court has scheduled December 15 as the date for delivering its verdict on the appeal aimed at compelling the Federal Government to release Nnamdi Kanu, the controversial leader of the Indigenous People of Biafra (IPOB). This development comes after the Court of Appeal in Abuja, on October 13, 2022, issued a judgment ordering Kanu’s release and dismissing the terrorism charges brought against him by the Federal Government. Dissatisfied with this ruling, the Federal Government lodged an appeal with the Supreme Court.
During the recent proceedings, a five-member panel chaired by Justice Kudirat Kekere-Ekun decided to set the judgment date after both parties presented their final briefs. Kanu’s lead counsel, Mike Ozekhome (SAN), used the opportunity to request not only the immediate release of Kanu but also the imposition of significant punitive costs against the government. Ozekhome emphasized the unconstitutional detention of Kanu since June 29, 2021, despite the lower court’s order for his release. He urged the Supreme Court to deliver justice and, in line with the precedent set in Ojukwu vs. State, send a clear message that no individual or government is above the law.
On the other hand, the Federal Government’s counsel, Tijani Ghazali (SAN), appealed to the apex court to overturn the Court of Appeal’s decision that ordered Kanu’s release. He also sought a directive for Kanu’s trial on terrorism-related charges to resume at the Federal High Court in Abuja.
